Mad Hawk Gear Terms & Conditions

By purchasing any product from Mad Hawk Gear, you acknowledge that you have read, understood, and agree to the following Terms & Conditions. These terms apply to all purchases, possession, ownership, and use of products sold by Mad Hawk Gear.


Assumption of Risk

Knives and edged tools are inherently dangerous and may cause serious bodily injury or death if misused.

By purchasing, possessing, or using any product sold by Mad Hawk Gear, the purchaser and user voluntarily assume all risks associated with ownership and use of these products.

Mad Hawk Gear shall not be liable for any injury, damage, or loss resulting from improper, negligent, reckless, or unlawful use of any product after transfer of possession to the purchaser.

Compliance With Laws

It is the sole responsibility of the purchaser to understand and comply with all applicable federal, state, and local laws governing the purchase, possession, ownership, transportation, and use of any product sold by Mad Hawk Gear.

Certain products, including but not limited to automatic knives or other regulated items, may be restricted or prohibited in some jurisdictions.

Mad Hawk Gear makes no representation or warranty regarding the legality of any product in the purchaser’s jurisdiction.

By placing an order, the customer represents and warrants that:

  • They are legally eligible to purchase the product

  • The product is lawful to possess in their jurisdiction

  • They are in compliance with all applicable laws


The customer assumes sole and complete legal responsibility for any violation of law arising from the purchase, shipment, possession, or use of any product.

Mad Hawk Gear shall not be liable for any legal penalties, damages, or consequences resulting from a customer’s failure to comply with applicable laws.

Limitation of Liability

To the fullest extent permitted by applicable law:

  • Mad Hawk Gear shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from the purchase, use, or performance of any product.

  • Mad Hawk Gear’s total cumulative liability for any claim shall not exceed the original purchase price of the product.

These limitations apply regardless of the legal theory asserted, including contract, tort, negligence, strict liability, or otherwise.

Indemnification

By purchasing from Mad Hawk Gear, the customer agrees to indemnify, defend, and hold harmless Mad Hawk Gear, its owners, officers, employees, affiliates, and agents from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorney’s fees, arising out of or related to:

  • Misuse of any product

  • Violation of any law or regulation

  • Injury to persons or property occurring after transfer of the product

  • Breach of any representation made by the purchaser

 

Age Requirement

By purchasing any product from Mad Hawk Gear, the customer represents and warrants that they are at least eighteen (18) years of age and legally permitted to purchase and possess the product in their jurisdiction.

Mad Hawk Gear does not knowingly sell products to minors and reserves the right to cancel any transaction believed to involve a minor.

Mandatory Arbitration & Class Action Waiver

Please read this section carefully. It affects your legal rights.

Agreement to Arbitrate

Any dispute, claim, or controversy arising out of or relating to the purchase, ownership, warranty, use, or performance of any product sold by Mad Hawk Gear shall be resolved exclusively through final and binding arbitration under the Federal Arbitration Act.

Arbitration shall be conducted before a single arbitrator administered by a nationally recognized arbitration organization selected by Mad Hawk Gear.

 

The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement.

Arbitration shall take place in the State of Florida, unless otherwise required by law.

 

Waiver of Jury Trial

 

The purchaser and Mad Hawk Gear knowingly and voluntarily waive any right to a trial by jury.

Class Action Waiver

All claims must be brought solely in the purchaser’s individual capacity and not as part of any class, collective, consolidated, or representative proceeding.

The arbitrator shall not have authority to conduct class arbitration.

If the class action waiver is deemed unenforceable, the remainder of the arbitration provision shall remain in effect to the fullest extent permitted by law.

Florida Governing Law

These Terms & Conditions and any dispute arising from the purchase or use of products sold by Mad Hawk Gear shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

Subject to the mandatory arbitration provision above, any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Florida.

Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

Force Majeure

Mad Hawk Gear shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including but not limited to:

  • Natural disasters

  • Acts of God

  • War or terrorism

  • Labor disputes

  • Governmental actions

  • Supply chain disruptions

  • Carrier delays

  • System failures

Acceptance of Terms

By purchasing any product from Mad Hawk Gear, the customer acknowledges and agrees to be bound by these Terms & Conditions.
